Injured in a Motor Vehicle Accident?
Understanding Your Options

Depending on your circumstances, a motor vehicle accident may involve two distinct processes: an application for Statutory Accident Benefits and, where legally available, a claim against a party responsible for the accident. These processes have different eligibility requirements, deadlines and available remedies.

Accident Benefits

Ontario’s Statutory Accident Benefits system may provide certain benefits to eligible people injured in motor vehicle accidents, regardless of who caused the accident. Depending on the accident date, applicable policy, coverage selections and individual circumstances, available benefits may include:

  • Medical and rehabilitation benefits, including eligible treatment and assessments
  • Attendant care benefits for eligible assistance needs
  • Income replacement or non-earner benefits, where applicable coverage and eligibility requirements are met
  • Additional benefits or increased limits where purchased or otherwise applicable
  • Benefits and assessment issues involving catastrophic impairment

Important: Ontario’s Accident Benefits coverage rules changed on July 1, 2026. Medical, rehabilitation and attendant care benefits remain mandatory under the revised framework, while other benefits are optional. Existing coverage and transitional rules may affect a particular claim. Eligibility and available amounts must be reviewed case by case.

We can assist with understanding application requirements, reviewing insurer decisions and identifying options when benefits or proposed treatment are denied, where the matter falls within the firm’s services.

Personal Injury Lawsuits (Tort Claims)

Where another person or entity may be legally responsible for an accident, an injured individual may also have grounds to pursue a personal injury lawsuit. Such claims can involve compensation for eligible losses, subject to applicable legal requirements, thresholds, deductibles and available evidence. A tort claim is separate from an Accident Benefits claim.

Psychological Injuries

Accident-related injuries are not always visible. Anxiety, depression, post-traumatic stress symptoms and other psychological difficulties may affect work, relationships, daily functioning and quality of life. Appropriate medical assessment and documentation can help clarify the nature and impact of these injuries. Whether compensation or benefits are available depends on the facts and applicable law.

Personal Injury Claims Involving Children

An accident can affect a child’s emotional well-being, education, development, treatment needs and daily activities. Claims involving minors require particular attention to their pre-accident functioning, medical evidence, future needs and applicable procedural requirements. Parents and guardians can contact our team to discuss the circumstances of a child’s injury.

Understanding Potential Compensation

The losses recoverable in a personal injury claim depend on the accident, legal basis of the claim, available evidence and applicable law. Depending on the case, potential areas for assessment may include:

  • Pain, suffering and loss of enjoyment of life
  • Past income loss and future loss of earning capacity
  • Treatment, rehabilitation and future care expenses
  • Housekeeping and functional limitations
  • Eligible family-related claims

No two cases are alike. Not every category of compensation is available in every claim, and statutory restrictions or insurance provisions may apply.

How We Approach a Personal Injury Matter

1 Initial Consultation

We listen to what happened, discuss your injuries and immediate concerns, and identify potential legal options.

2 Investigation and Evidence

Relevant accident records, photographs, witness information, medical records, employment information and insurance documents may be reviewed.

3 Treatment and Loss Assessment

We consider the available medical evidence, recovery, functional limitations and financial impact as the matter develops.

4 Insurance, Negotiation and Litigation

Where appropriate, the matter may involve insurer communications, negotiation, mediation or court proceedings.

5 Resolution and Next Steps

We explain proposed resolutions, relevant documentation and next steps so clients can make informed decisions.

Client Communication & Ongoing Support

At Panu Law Professional Corporation, we believe that consistent communication is an essential part of effective legal representation. We maintain regular contact with our clients throughout their cases to stay informed about their recovery, medical treatment, changing circumstances and ongoing needs.

We understand that every client's situation evolves, which is why we prioritize open communication, provide timely updates on case developments and ensure our clients remain informed and supported at every stage of the legal process.

What to Do After an Accident

  • Seek appropriate medical attention and report the incident to the relevant authority or insurer as required.
  • Photograph the scene and preserve available witness information, if safe to do so.
  • Keep medical records, receipts, employment records and insurance correspondence.
  • Take care when providing statements or signing releases, and seek legal advice promptly.

Important Deadlines

Ontario personal injury matters can involve limitation periods and, in some situations, much shorter notice requirements. Claims involving municipalities or certain snow-and-ice incidents may have special rules. Do not assume that ongoing treatment or insurer correspondence extends a legal deadline. Seek advice promptly so the requirements relevant to your situation can be reviewed.

FREQUENTLY ASKED QUESTIONS

Do I have a personal injury claim?

That depends on how the incident occurred, the injuries and losses involved, potential legal responsibility, insurance coverage and applicable deadlines.

Can I receive Accident Benefits if I caused the accident?

Certain Accident Benefits may be available to eligible people regardless of fault. Available coverage and eligibility depend on the accident date, policy and circumstances.

What if my insurer denies treatment or benefits?

A denial should be reviewed along with the insurer’s reasons, supporting medical evidence and any applicable dispute deadlines.

Can I claim compensation if I cannot return to work?

Depending on the case, income-related losses may be relevant to a tort claim. Income replacement or other Accident Benefits may also be available where applicable coverage and eligibility requirements are satisfied.

What if my child was injured?

A child may have legal rights arising from an accident. Claims involving minors have particular evidence and procedural considerations.

How much is my claim worth?

There is no universal formula. Liability, medical evidence, prognosis, financial losses, applicable thresholds and insurance coverage may affect the assessment.

What if I was partly responsible?

Partial responsibility does not necessarily prevent a claim, but it can affect available compensation. The specific facts must be assessed.

How long will my case take?

Timeframes vary with medical recovery, evidence, negotiations and whether litigation is required.

Should I settle quickly?

A settlement may be final. Consider the available evidence, prognosis and potential future losses before making a decision.

How much does hiring a personal injury lawyer cost?
